In other words, each State has the right to regulate it according to its own laws on online poker and can therefore establish an agreement for the practice of Interstate online poker defined by their respective laws. The gains are variable but as soon as players cash in gains on a regular basis, the tax administration no longer considers poker and other online games as a game of chance, which leads to an opening to a tax on earnings. Ms Filippetti said in this regard that "the issue of taxation on earnings of professional players of poker is recurrent and has so far been settled."
