Internet provider: Obligation to block illegal gambling websites, opinions are divided!
Last week, the representatives of main regulators of online gambling in Europe (Italy, France, Spain, Germany, Portugal and United Kingdom) met in Rome in order to discuss about the evolution of regulated markets of online gambling, including mainly online poker and sports betting. The implementation of new measures against illegal operators was tackled. Since many years, regulators try to fight against illegal offer, and one of the solutions undertaken counts on the intervention of Internet Provider. In fact, regulators impose to provider to block the content of websites of poker and online gambling judged illegal, without having recourse to justice. But providers dont agree with this opinion.
In France, the decree n° 2011-2122 of December 30th, 2011 orders Internet providers to block the access of an illegal gambling operator, which has not received the approval of the ARJEL (French Regulation Authority of online gambling). Published by the French government in the Official Journal, the said decree was effective from Sunday, January 1st 2012. This obligation to block websites of illegal gambling was reminded by the judgment of the final court of appeal, in December 10th 2013. In England, British Internet providers have rejected the same request, this time proceeding from the Gambling Commission of the United Kingdom, only after an order of a court of justice. British Telecom (BT) and TalkTalk are among these Internet providers which were opposed to the voluntary blocking of websites, and which dont want to be considered as «unofficial police of Internet», according to their own statement on Financial Times.
