UK: Towards a tax based on the location of the player
The United Kingdom decided to make a change in the terms of the bill on legislation of online games, including online poker. The new bill has been introduced on December 3. It was developed following a consultation launched in April 2012 and may be applicable from the end of 2014. As a reminder, the UK Gambling Commission, which oversees the regulation of the online gaming market in the UK is active since 2005, so all operators who have a UK license or a license delivered by countries belonging to the white list namely members of the European Economic Area or EEA, Gibraltar, Isle of Man and Alderney may exercise legally on the UK market. They just need to pay a tax rate of 15% levied on gross profits.
If the bill passed, operators must apply for a license at the Gambling Commission and must comply with regulations imposed in the Gambling Act whether in respect of the standards and techniques of game software used or in the setting of preventative measures against gambling addiction. And the authorities are also considering setting up an organization for licensing. But the biggest change discussed in this new bill is on taxation. In fact, now, the 15% tax on profits, whether in poker or on other online game will now be taken depending on the location of the players. This change has been the subject of many criticism among operators. The latter believe that this measure will push 40% of British players to migrate to illegal gambling.
