Online Poker: Towards a new tax law for France
Since the regulation of online gambling provided by the Act of May 12, 2010, taxation became the subject that comes up frequently inside debate whatsoever on the part of operators, regulator or the parliament. The tax on gambling and online poker will be soon debated in the French National Assembly in the budget 2012 of the Finance Act following the submission of Amendment No. 363 by the deputy Jean-François Lamour. This amendment already adopted by the Committee of Finance aims to modify the Act of May 12, 2010 which covers the replacement of the tax recovery on the bet by the tax on the gross gaming revenue (GGR), which is as reminder based on the bet of players and their earnings.
The majority of these entities are in favour of the tax on GGR but Valérie Pécresse, Minister of the Budget, does not seem to agree. And this opposition of idea could change anything on the current taxation of online gambling. The reason is that the changing of the current taxation of online gambling could lead to risks of tax evasion. A report of the Minister of Budget will be soon submitted to the Government for this purpose. Thus, there are those who are in favor of the GGR and those who want to maintain the tax already in place. But anyway, poker and other online games can know a new destiny by the end of November. And the tax on the earnings of players will be at the heart of the debate.
