Switzerland: The Federal Council refuses to authorize tournament out of casinos
The Swiss Federal Council decision concerning the prohibition to hold poker tournaments outside of casinos has been stringent. It decided to not consider the two requests of Jacqueline Fehr (PS / ZH) and Jean-Pierre Grin (UDC / VD) who demanded a revision of the law. The Federal Council explains that it is unthinkable to bend on the principles at the base of the law on gambling to outweigh the arguments of social protection. The Council to continue that it is not possible to validate legal provisions allowing the practice of gambling and games of chance outside of casinos throughout the Swiss Community. The government noted for its part that adopting it will conduct to a dysfunction in case of an exemption granted to poker but not for other games.
To recall, the Socialist candidate mentioned in the text submitted to the Federal Council that poker should be considered as a game of skill, especially the variant “Texas Hold'em", which thus could be played legally in tournaments outside gambling houses and could not tempt young people to enter casinos. For the UDC National Councillor, he suggested the deliverance of license to tournament organizers. The Federal Court decision, however, continues to consider poker as a game of chance, a game behind numerous unemployed, it said. In March 2010, the National Council of the UDC has already validated a legal motion asking for the legalization of the organization of poker tournaments in private clubs. An increasingly political pressure is felt by the government day to day to revise its stance.
