French law online games: Opinions diverge on the zero setting of accounts
Debates are in its highest level in the sector of online games concerning websites of online poker, sports betting and horse-races about the zero setting of the accounts of French players on websites already existing. Indeed, one of the clauses forced by the authority of regulation of the online games (ARJEL) to obtain the French license to operate in this sector is to put in zero the accounts of French players. However this clause is discriminatory owing to the fact that La Française des Jeux (FDJ) and the PMU are not concerned of this measurement. For a few months, these two State companies have however had the possibility to propose to their players to forecast on a match of foot or to validate a lotto ticket or horse-race ticket on the Internet. And these old State monopolies will not be obliged to put their accounts in zero in 2010, date on which the market of online game will be open in France.
According to private operators, any equal treatment between the FDJ and the PMU with the whole sites of online game does not exist because these latter will have to respect clauses not subjected to the two public companies. Moreover, the two old State monopoles take a length in advance on their competitors as regards to communication because they are authorized to make publicity whereas other sites of online game are considered as outlaw and cannot in theory make promotion of their sites. But nevertheless, certain sites of online game which do not have a French license yet diffuse advertisement in information sites such as Le Figaro or Paris Match where their publicities appear without any problem.
