Game of chance or skill: The status of poker may turn everything upside down

Poker raises currently a major debate in France, especially about its juridical status. The question is whether poker is a game of chance or a game of skill. For amateurs, the answer is clear : poker is a game of skill but according to legal institutions in France and also all around the world, the answer is still unclear. The debate began some time ago in the Court of Toulouse during the prosecution of Jean-Pierre Gleizes, owner of a poker room, where he hosted poker games for public without having obtained a license from a competent authority as the ARJEL. The court acquitted the accused of all charges based on French law and jurisprudence. The French government subsequently filed an appeal in front of the Council of State as the defense chosen by the accused was based on the nature of poker.



The verdict of the previous litigation involves the jurisdiction of the ARJEL, the Regulatory Authority of Online Games, the licensing and the heavy tax on poker operators on the French market. Thus, if we refer to this ruling, the licensing and regulation are involved. Operators can operate without the advice and consent of the ARJEL. Poker was more recently described as reasoned gambling according to the Court of Versailles but to see the evolution of poker today, the French legal institutions are facing a real game of skill. Indeed, many players make it a real job. A case to follow !
