Netherlands: Preparation of a new law about online poker

Granting licenses to some operators on the market of online poker of Holland, this is the suggestion of the Jansen Commission to legislators which analyzed this domain for nearly a year in its report dated on Monday, August 23th, 2010. A report expected out in March of this year but with the legal dispute between Holland Casino on one side and some private operators, the commission had to wait the decision of the European Court of Justice in favor of a monopoly in Netherlands. It is well known that poker is very demanded by the population, and one online poker provider could not meet the need of all Dutchman. In addition, a recent ordinance by the Court of The Hague gave another very clear decision, poker was not considered as a game of luck and organizer of a physical tournament is in accordance with gambling current laws in the Netherlands.



But the Jansen Commission advises the legislature to stop the activities of illegal operators through Internet access providers, imitating the way taken by France and Italy. As for sports betting and horse racing, the committee is favorable to the strict management of Holland Casino. The Netherlands is following in step with other European countries in case of application of renewable licensing system by the legislature. Moreover, the government of Holland hesitates about the market regulation of online gambling as it is also the case of Greece, Finland, Portugal, Slovenia, Hungary and Germany.
