Online poker : Hard fight against tax evasion

Only poker sites located on French territory are subject to taxation and control of the French State at the moment with as unique imposition tax 2% of all stake on each gaming table. The fact that is problematic to the new Regulatory Authority of online games or ARJEL is the definition of the extent of the perimeter leaving the field open to fraud and tax evasion to which control is supported by strict rules of the OECD in March 2010. In the other hand, the new French draft law in its Article 21 concerning online games clearly states that only operators having an agreement containing an administrative assistance clause in the fight against fraud and tax evasion have the right to apply for registration as gaming operator. This is also in contradiction with the principle of free movement of goods, services and people of countries member of the European Union.



For ARJEL, the role is limited in the verifying of the transparency of ownership, financial strength and reliability of technical infrastructure, and it should let the commission within the Department of Budget decide if a problem occurs. As can be seen in tax havens, this situation leaves considerable space to the practice of illegal conduct for online poker sites newly approved overseas as Pokerstars located on the Isle of Man, Winamax in London, Betclic and Everest Poker in Malta, and Bwin between Gibraltar for its bookmakers and Vienna for its employees.
