Advertisement on poker and online games: Verdict of the CSA in June

The liberalization of online games (sports and horse betting, poker) in France implies that an operator holding a gaming license is allowed to promote its product on the French territory. This is easier to say than to do. As it will take two months to the Regulatory Authority of Online Games (ARJEL or Autorité de Régulation des Jeux en Ligne) to investigate the claims, an operator who will advertise before will automatically dismiss for violations of rules and will therefore had bad press with regard to those who comply with the instructions but will then be very delayed in their marketing promotion.



In view of the public consultation on the subject that the High Council for Audiovisual (Conseil supérieur de l'Audiovisuel or CSA) launched on April 23rd, everything look complex. Indeed the consultation offers several opportunities for different operators. For TV, there are three options. First option, no advertising or sponsorship of 6 to 9 hours, from 12:00 to 2:00 p.m. and 5:00 p.m.-9:00 p.m. on Monday, Wednesday, Thursday and Friday and Wednesdays from 6:00 to 11:00 p.m.. Second option: no advertisement on 5:00 pm to 22:30 and third option: banning at the same time, but with special exceptions during sports events, horse racing, and five minutes before and after these programs. Regarding the radio, it's less fuzzy than the TV. First proposal, banning of advertising from 5:00 p.m. to 0:00. Second proposal, banning from 5:00 p.m. to 0:00, but with special permission. The High Council for Audiovisual will decide between June 1st and 15th.
