Online gambling: “Cybercasinos” deny French justice
Through their respective lawyers, the four sites of online gambling (Bwin, Unibet, Sportingbet and 888), refuse this Monday in Paris the French justice. They estimate that the justice does not have the right to statute on the dispute which opposes them to 104 terrestrial casinos in France. And later, on Tuesday, the lawyers of the four sites asked the relaxed of theses four companies and their leaders included in this matter. Recall of the facts, 104 French terrestrial casinos had lodged a complaint on these “cybercasinos” in the correctional court of Paris for “illegal competition”. The French casinos estimate that the activity of these foreign sites which propose online gambling, poker, casino and sports betting online, to millions of French players are out the law and can harm their activities. So the French casinos want to prohibit in France these sites of gambling at least for two years.
On his side, Olivier Gutkes, one of the lawyers of Bwin thinks that the use of French in his site “does not give to the French judge the competence” to decide on a company located abroad. The lawyer of Sportingbet Martine Karsenty-Ricard affirms that even if the server of the site which can be compared like “a house of gambling”, and that the illegality is blamed by the French casinos, the server is not on the French territory. So, the site cannot be sued in France. The judgment of the court was reported for next Wednesday April the 14th.
