Denmark: An unemployed person confiscated of a gain of €26,000

Since a few years, Scandinavian countries became a real cradle of champions of poker. Denmark appears with its numerous champions of poker as Bloke Hansen or Peter Eastgate. A lot of Danish professional players improved on websites of online poker. Since the emergence of these new champions, online poker had more and more success in Denmark and the country counts now not less than 50,000 players who are used to online game. But Danish Supreme Court of justice has however just ordered, quite recently, seizure of gains at online poker of an unemployed Danish aged of 35 years old, a gain around €26,000. The Justice considered that these increase were obtained from sites of offshore game or resulting from a foreign country since a machine situated in the Danish jurisdiction. So, the user had to submit himself to the Danish legislation.



Indeed the Danish law prohibits every person living on its territory to earn money only by playing gambling games. At the same time, doing poker as a livelihood is prohibited, and all persons doing this will be considered guilty according to the current law in this country. As a lot of countries, Denmark practises legislation more than restrictive towards online games especially when it is about gambling games (poker, black jack, roulette, bingo). This restrictive practice is characterized by a State monopoly whether it is in the gambling games or bets. We shall also note a disproportionate taxation of gains. The young player Peter Eastgate made an unfortunate experience, his gains during the World Series of Poker had nearly been taxed of 73 %.
