Sports betting: Some failure noted on the French online law
It is good to remember that with the French new law on online games, gamble operators proposing services of sports betting are henceforth going to pay federations. In the future, operators of sports betting will risk prosecutions by federations in case of not conclusion of contracts of operation or if they did not receive the approval from them. Doubt flats right on whether if the current measures of the sport Code allow such control on over offers of bets. The adoption of this article is going to cross off any uncertainty. The section 52 of the bill, which aims first of all at the offers of sports betting, wants that the use for commercial purposes, of any characteristic element of the events or the sporting events, in particular their naming, their calendar, their data or their results, cannot be made without the consent from the owners of the exploitation rights.
But Brussels considers this limitation of the freedom to offer sports betting service not validated yet as unfavorable. The European Commission considers that this new law is going to reduce or going to make less attractive offer of sports betting in France. It is sure that this new rule would bring a financial windfall whether for organizers of sports betting or for sports federations. But this windfall risks to benefit only to the most popular media sports such as tennis or football. Competition forces, face to the heavy loads which are imposed on operators, they will look certainly for the most profitable sports. Some federations which are already rather weak financially will be sidelining, a pooling of income between federations would turn out more equalitarian.
