Legislation about online games : Review of the taxation in Italy
The Italian law concerning online games and online poker which was established two years ago and through which the future French law inspired has just been modified. With the existence of the taxation on stakes in this legislation, Berlusconi’s administration finally admits that this clause penalizes game operators having licence in its territory and it could damage their competitiveness. Indeed, taxes directly applied on stakes are too sultry for enterprises. “A game operator takes between 2% to 5% of the pot, reaching the ceiling of $3”, Alexandre Dreyfus, director of a gamble website told to talk about the tightness of the margins they deduct in advance. Italian authorities accepted so to place this tax on game gross product, with a 20% rate.
In France, the same principle of taxation as the ancient Italian law is nevertheless considered by Eric Woerth and his team at the Ministry of Budget. “Online poker operators necessarily have to convince French government to modify taxation of 2% deducted on stakes foreseen by the government bill”, M. Dreyfus continues. Indeed, it will be the competitiveness on the international market of the operators holding this licence which is concerned. With a too high tax, these same companies won’t be able to propose services like sponsoring, special offers and other commercial tools in order to seduce players of online poker and betting sports. Moreover, this 2% tax on stakes doesn’t foresee any maximum ceiling. If the French state doesn’t give way, it runs the risk of collecting less tax.
