London Bar Owner to Set Poker Precedent?

Derek Kelly, the owner of the "Gutshot," a trendy pub in London, is currently being prosecuted for hosting illegal poker games in his establishment. According to authorities, Kelly has been violating the Gambling Act because, in the U.K., only licensed gambling venues, such as casinos, are allowed to organize poker games and poker tournaments.

If Kelly is ultimately exonerated of the aforementioned charges, his line of defense could have far-reaching implications for the U.K. poker industry.

Indeed, if Kelly manages to convince the court that poker is a game of skill, like chess, and not of chance, like blackjack or roulette, any other U.K. public venue would be entitled to operate poker tournaments. However, if he fails to make his case, he would face a prison sentence and might lose his business. Kelly's trial is scheduled to open early next year.
